OEC-01 · Adversarial-capital assessment

Assess adversarial capital flows into defense-relevant businesses

Assess investments from governments of adversary countries, or entities organized under their laws or otherwise subject to their jurisdiction, in industries or businesses of interest to DoD, in consultation with other DoD and Federal components.

What this is not / limit: Assessment is not a standalone power to block investments, compel disclosures, or exercise CFIUS authority.

Eligibility gate

  • The investment must fall within the adversarial-capital-flow definition in §9025(d)(1).

OEC-02 · Critical-technology prioritization

Prioritize critical technologies and assets needing capital assistance

Identify and prioritize promising critical technologies and assets for the Joint Force that need capital assistance, including those available from foreign entities.

What this is not / limit: Prioritization is not an award, loan approval, or proof that a proposed recipient is eligible for a particular instrument.

OEC-03 · Investment funding

Fund investments in critical technologies and assets

Fund investments in the critical technologies and assets identified for the Joint Force, including supply-chain technologies not always supported through direct investment.

What this is not / limit: This is an express investment-funding duty, not merely coordination; the subsection does not specify an unrestricted direct-equity portfolio or particular financing instrument.

OEC-04 · Scouting and investment coordination

Coordinate technology scouting and acquisition investment decisions

Support outreach and coordination by DoD scouting and acquisition elements so their investment decisions can counter adversarial capital flows, including use of relevant authorities vested elsewhere in DoD or the Federal Government.

What this is not / limit: Coordination does not automatically transfer another component's authority or authorize OEC to sign its awards.

OEC-05 · Vital-asset development

Accelerate vital-asset development, construction, procurement and leasing

Identify, accelerate and sustain vital tangible and intangible national-security assets through establishment, research, development, construction, procurement, leasing, consolidation, alteration, improvement, modernization and repair.

What this is not / limit: The office duty does not state a blanket exemption from fiscal, acquisition, leasing or military-construction requirements.

OEC-06 · Capital-assistance support

Help DoD provide loans, loan guarantees and technical assistance

Help DoD provide capital assistance to entities, including foreign entities, whose investments facilitate the Department's efforts. The statutory definition covers loans, loan guarantees and technical assistance.

What this is not / limit: Helping DoD provide assistance is not verification of an independently operating OEC direct-loan or guarantee program.

OEC-07 · Analytical-tool experimentation

Prototype and validate due-diligence analytical tools

Experiment with, prototype, test and validate government or commercial analytical tools, processes and tradecraft to improve DoD due diligence and investment analysis, including use of relevant delegated authorities vested in other components.

What this is not / limit: The reference to delegated authorities does not establish a blanket OT power or prove that another component's power has been delegated to OEC.

Engage, coordinate and collaborate with DoD and other Federal components to improve efficiency and develop whole-of-government national-security solutions.
